Can I stop making repayments once you have taken on my case?

To ensure your credit rating is the same as it was before you started the claim you must keep up the repayments until you receive written confirmation telling you that you can stop making them.

Can I reclaim all of my previous Payments?

If your agreement is unenforceable the outstanding balance will be written off, with regards to previous payments this will depend on which part of the Consumer Credit Act your lender has not complied with, in some cases previous payments could be reclaimed.

Can I still use my credit card after it has been written off?

No, your credit card will be placed on hold during the investigation of your credit card claim; once the claim is completed the account will be closed.

If I have an unenforceable credit agreement can the lender sell the debt to a debt purchasing company?

No.

Does it matter if I am in an IVA?

If you are in an IVA then unfortunately we cannot help you.

Will I have to discuss this with the Creditor?

No, once you have given authorisation for us to deal with the complaint on your behalf the creditors cannot hassle you in relation to the claim, simply remind them that we are dealing with this issue should they contact you.
